Terms of Use

1. Who we are

Gathr is published by Faustin Boiselle, an individual based in Barcelone (Spain). Contact: contact@gathr.group.

2. What Gathr does

Gathr lets you discover and organise parties within your network of friends and friends of friends: request a place, pay, receive a ticket, chat with the other guests and set up gift pots. Gathr is a platform that connects people: Gathr does not organise the parties, its members do.

3. Your account

• You must be at least 18 years old.
• The information you give must be accurate and up to date. One account per person.
• You are responsible for your password and for what happens on your account. Let us know at contact@gathr.group if you think someone else has used it.

4. Identity verification

To host a party, receive payments or join a party reserved for verified members, you must verify your identity with our provider Didit. It confirms that you are an adult and that your account belongs to a real person.

5. Hosting a party

The host is solely responsible for their party. In particular, they agree to:

• describe the party honestly (place, times, price, number of places);
• comply with the applicable laws: noise, neighbours, safety, venue capacity, sale and consumption of alcohol, adults only;
• have the right to use the venue and, where needed, the appropriate permits and insurance;
• welcome the people who have a confirmed place, or cancel the party in good time if they can no longer host it.

To receive payments, the host opens a payout account with Stripe and accepts its terms. The host is responsible for declaring their income according to the rules that apply to them.

6. Attending a party

• A place request can be accepted or refused by the host.
• Your ticket is in your name: it cannot be resold or transferred.
• The party's address is shared with you once your place is confirmed. Do not share it beyond the guests.
• If you can no longer come, release your place in the app so that someone else can enjoy it.

7. Prices, payments and refunds

• The price of a party is set by the host. Gathr adds a service fee, always shown before payment.
• Payments are processed by Stripe. The money is paid out to the host through their Stripe account.
• If the party is cancelled by the host or by Gathr, you are refunded in full, service fee included.
• If you cancel your place more than 48 hours before the start, you are refunded in full. Less than 48 hours before, no refund is due.
• If an administrator removes you from a party, you are refunded in full.

A ticket for a party on a specific date is a leisure service: the 14-day right of withdrawal therefore does not apply, but the refund rules above still do.

8. Surprise gift pots

• A group member can create a gift pot to offer a present to another member. The person being celebrated does not see it.
• The money is paid directly to the creator of the pot, who agrees to use it for the announced gift.
• Gathr takes no commission on gift pots. Only Stripe's fees apply, and they are shown before you contribute.
• If the pot is cancelled, each contributor is refunded the amount they paid.

9. Group chats

Each party has a group reserved for the host and the people with a confirmed place. Nobody can write in it 48 hours after the party starts. The community rules apply there too.

10. Community rules

On Gathr and during parties, it is forbidden to:

• harass, threaten, insult or discriminate against anyone;
• post content that is illegal, violent, sexual without consent or that invades someone else's privacy;
• use a fake account or impersonate someone else;
• resell places or use Gathr for commercial purposes without our agreement;
• sell or supply drugs, or serve alcohol to minors;
• try to get around Gathr's security.

Your reliability reflects your attendance at finished parties where you had a place. It starts at 100% and goes down if you do not come without having released your place.

11. Moderation

If these terms are not respected, Gathr may remove content, remove someone from a party (with a full refund), cancel a party, suspend an account for a limited time or delete it permanently. If you think a decision is a mistake, write to us at contact@gathr.group.

12. Liability

Gathr provides the app and does its best to make it work properly, but cannot guarantee that it will never be interrupted or contain errors. Gathr does not organise the parties and is not responsible for how they go, nor for how members behave during them.

Nothing in these terms limits our liability where the law does not allow it, in particular for gross negligence or personal injury, nor the rights you have as a consumer.

13. Your content

You remain the owner of what you post (photo, party description, messages). You allow Gathr to display it in the app, only to run the service and to the people concerned. The Gathr name, its logo and the app belong to their publisher.

14. Deleting your account

You can stop using Gathr at any time and ask for your account to be deleted at contact@gathr.group. Confirmed places and ongoing gift pots are handled according to the rules above.

15. Changes

We may change these terms. If there is an important change, we will let you know in the app or by email before it takes effect. If you disagree, you can delete your account.

16. Applicable law and disputes

These terms are governed by Spanish law. If there is a problem, please write to us first at contact@gathr.group: we will look for an amicable solution. If you are a consumer, you keep the protection of the laws of your country of residence and can go to the courts where you live.
